These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and AI100 OÜ, a private limited company registered in the Republic of Estonia, registry code 16993057, registered address Harju maakond, Tallinn, Kesklinna linnaosa, Tornimae tn 5, 10145 ("Company", "we", "us", or "our").
By accessing or using the AI100.io website and services ("Service"), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Definitions
Service — the AI100.io website, API, and all related tools and content provided by the Company for measuring brand visibility in AI-generated responses.
Research Run — a single execution of the AI100 benchmark methodology against a specified brand, consuming one unit from the Customer's key balance.
Access Key — a unique credential issued to the Customer upon payment, granting the right to launch Research Runs and access resulting Reports.
Report — the structured output of a Research Run, including visibility scores, competitive analysis, diagnostics, and growth recommendations, delivered in HTML, XLSX, and/or CSV format.
Open Content — publicly accessible portions of the Service, including methodology descriptions, sample reports, knowledge base articles, and FAQ, available without an Access Key.
2. Service Description
AI100 is a brand visibility benchmark that measures how AI systems (large language models and answer engines) discover, interpret, and recommend brands in their responses. The Service provides standardized research: we query AI models with a corpus of scenarios, measure brand visibility, and deliver a structured Report.
AI100 is a research and measurement tool. It does not guarantee any specific business outcome, increase in revenue, improvement in search rankings, or change in AI visibility as a result of using the Service.
3. Eligibility
The Service is intended for business professionals, entrepreneurs, and organizations. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
4. Access Keys and Account
4.1. Access to Research Runs is provided through personal Access Keys. A Key is activated upon successful payment and grants the right to launch Research Runs and view resulting Reports.
4.2. Each Access Key includes a fixed number of Research Runs as specified at the time of purchase (currently 200 runs per key). One run is consumed when a new Research Run is initiated. Viewing previously generated Reports does not consume runs.
4.3. Access Keys are personal and non-transferable unless explicitly agreed in writing by the Company.
4.4. You are solely responsible for maintaining the confidentiality of your Access Key. You must notify us immediately at [EMAIL] if you believe your Key has been compromised.
4.5. We reserve the right to suspend or revoke an Access Key if we reasonably believe it is being used in violation of these Terms.
5. Pricing and Payment
5.1. The current price is USD 999 per Access Key (200 Research Runs). All prices are stated in US dollars and are exclusive of any applicable taxes.
5.2. We accept payments via bank transfer, credit/debit cards (processed by Stripe, Inc.), and cryptocurrency. The available payment methods and applicable procedures are described on the payment page at the time of purchase.
5.3. Payment processing is handled by third-party payment service providers. By making a payment, you also agree to the applicable terms and privacy policies of the respective payment processor:

5.4. You are responsible for any taxes, duties, or fees imposed by your jurisdiction in connection with your purchase.
5.5. Prices may change at any time. Price changes do not affect already purchased Access Keys.
6. Right of Withdrawal and Refunds
6.1. If you are a consumer within the European Union, you have the right to withdraw from this contract within 14 days of purchase without giving any reason, in accordance with Directive 2011/83/EU.
6.2. However, by initiating a Research Run, you expressly request that the Service begin during the withdrawal period and acknowledge that you lose the right of withdrawal for that specific Research Run once performance has begun, as the service involves immediate and irreversible consumption of third-party API resources.
6.3. For Access Keys where no Research Runs have been launched, you may exercise the right of withdrawal within 14 days of purchase by contacting us at [EMAIL]. We will process the refund within 14 days using the same payment method used for the original purchase.
6.4. Refunds for used runs: Because each Research Run incurs immediate and irreversible costs (queries to third-party AI models), we do not offer refunds for consumed runs.
6.5. If a Research Run fails to complete due to a technical error on our side and no Report is delivered, the consumed run will be restored to your balance. Contact us at [EMAIL] to report such issues.
7. Research Reports
7.1. Reports generated through the Service are provided for your internal business use. You may share your Reports with colleagues, advisors, business partners, and clients.
7.2. You may not: (a) resell Reports as a standalone commercial product; (b) systematically redistribute Reports to the public; or (c) use Reports or their data to build, train, or operate a service that competes with AI100.
7.3. The research methodology, scoring algorithms, prompt corpus, enrichment logic, and underlying source code are the Company's proprietary intellectual property and trade secrets. They are not included in or licensed with Reports.
8. Accuracy, Limitations, and Disclaimers
8.1. AI100 measures brand visibility in AI-generated responses at a specific point in time. Results depend on the AI model's behavior at the time of the run, the brand's online presence, available web sources, and the research parameters selected.
8.2. We use commercially reasonable efforts to ensure measurement quality, but the Service is provided "as is" and "as available." We do not warrant that results are complete, error-free, or will remain stable over time. AI model behavior changes independently of our Service.
8.3. AI100 does not measure sales, revenue, market share, product quality, customer satisfaction, or offline brand reputation. The score reflects visibility in AI-generated answers only.
8.4. Results should not be used as the sole basis for business, investment, or legal decisions. We recommend treating AI100 data as one analytical input among many.
8.5. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Open Content
9.1. Certain portions of the Service — including methodology descriptions, sample reports, knowledge base articles, and FAQ — are publicly accessible without an Access Key and are provided for informational and educational purposes.
9.2. You may reference and link to Open Content with appropriate attribution. You may not: (a) reproduce substantial portions without attribution; (b) use Open Content to train AI or machine learning models; or (c) present Open Content as your own original work.
10. Acceptable Use
You agree not to:
(a) attempt to reverse-engineer, decompile, or otherwise extract the scoring methodology, prompt corpus, or source code of the Service;
(b) use automated tools (bots, scrapers, crawlers) to systematically extract content or data from the Service;
(c) interfere with, disrupt, or compromise the security or integrity of the Service;
(d) use the Service to generate or disseminate materially false or misleading claims about competitors;
(e) resell, sublicense, or share Access Keys with third parties for commercial purposes;
(f) use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
11. Intellectual Property
11.1. All content, methodology, software, design, text, graphics, and branding of AI100.io are owned by the Company or used under license. "AI100" and the associated logo are trademarks of the Company.
11.2. Brand data, URLs, and parameters you submit remain your property. By using the Service, you grant us a limited, non-exclusive, non-transferable license to process your submitted data solely for the purpose of delivering the Research Run and generating the Report.
11.3. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited rights expressly set forth herein.
12. Third-Party Services
12.1. The Service relies on third-party AI model providers (including but not limited to OpenAI, LLC) to execute research scenarios. We do not control these providers and are not responsible for changes in their behavior, availability, output quality, or terms of service.
12.2. Payment processing is handled by third-party providers as described in Section 5. We are not responsible for the actions, errors, or policies of payment processors.
12.3. We make commercially reasonable efforts to select and configure third-party services for consistent quality, but we cannot guarantee their availability or performance.
13. Availability and Maintenance
13.1. We aim to maintain reasonable availability of the Service but do not guarantee uninterrupted, continuous, or error-free operation.
13.2. We may perform scheduled or emergency maintenance that temporarily affects availability. Where practicable, we will provide advance notice of planned maintenance.
13.3. We are not liable for any losses or damages resulting from Service unavailability due to maintenance, infrastructure issues, third-party service disruptions, or force majeure events.
14. Limitation of Liability
14.1. To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, goodwill, or anticipated savings, arising from or related to your use of the Service.
14.2. The Company's total aggregate liability for any and all claims arising from or related to the Service shall not exceed the total amount actually paid by you to the Company under the Access Key giving rise to the claim during the twelve (12) months preceding the event giving rise to liability.
14.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
15. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable laws or third-party rights.
16. Modifications to Terms
16.1. We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date.
16.2. For existing Customers with active Access Keys, we will use reasonable efforts to notify of material changes (e.g., via the Service interface or email if provided).
16.3. Your continued use of the Service after the effective date of updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.
17. Term and Termination
17.1. These Terms remain in effect for as long as you use the Service or hold an active Access Key.
17.2. You may stop using the Service at any time. Termination does not entitle you to a refund for unused runs unless the right of withdrawal under Section 6 applies.
17.3. We may terminate or suspend your access immediately and without notice if you materially breach these Terms.
17.4. Upon termination, your right to launch new Research Runs ceases. Access to previously generated Reports will remain available for a reasonable period (currently 12 months) unless otherwise required by law.
18. Governing Law and Dispute Resolution
18.1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of laws provisions.
18.2. Any disputes arising from or in connection with these Terms shall be resolved by negotiation in good faith. If a dispute cannot be resolved within 30 days, it shall be submitted to the Harju County Court (Harju Maakohus), Tallinn, Estonia.
18.3. If you are a consumer within the European Union, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
18.4. Nothing in this section limits your rights under mandatory consumer protection laws of your country of residence.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the intended economic and legal purpose.
20. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service, superseding any prior agreements or understandings.
21. Language
These Terms are available in English and Russian. In case of any inconsistency between versions, the English version shall prevail.
